Rules for selling goods

Welcome to PLAZARIUM.COM. PLAZARIUM LLC and / or its affiliated companies ("PLAZARIUM") offer products in our online store at plazarium.com (hereinafter "PLAZARIUM Store").

Goods at PLAZARIUM Store are sold on the following conditions:
PLAZARIUM Llc., Moscow, established and registered under the law of Russian Federation, located at the address: 8 Tvardovskogo Str., bld. 1, 123458, Moscow, Russian Federation, in the person of Director General Tverskoy Vladimir Semenovich, acting on the basis of the Statute, hereinafter referred to as "Seller" of the one part, and the User PLAZARIUM Store, hereinafter referred to as "Buyer", of the other part, have concluded the present Agreement as follows:

1. General information
1.1. Relations between buyers and sellers in the sale of manufactured products using a remote method, as well as the list of product models listed in the section «Products» of this website (hereinafter referred to as the "Product") shall be governed by the laws of the Russian Federation.

1.2. The product is an original instrument and is classified as technically complex and expensive goods in respect of which the customer requirements of replacing them (refund) shall be satisfied only in the presence of significant shortcomings. This product is included in the «List of non-food products of good quality, are not subject to return or exchange for similar goods of other size, shape, dimensions, style, color or configuration», according to which «...11.Technically complex household products with warranty period of ( … )» (Russian Federation Government Decree № 55 from January 19, 1998) shall not be returned or replaced.

1.3. Contract of retail purchase and sale can be concluded on the basis of user acquaintance with product description at PLAZARIUM Store provided by the seller contained on this web site, catalogs, brochures, booklets, represented on pictures, through different means of communication or other excluding the possibility of consumer’s direct study of the product or product model at the conclusion of such an agreement (remote method of selling goods).

1.4. Information on basic consumer properties of goods, the address (location) of the seller, the place of goods manufacture, full company name of the seller (manufacturer), price and terms of purchase, its delivery, lifetime, durability and guaranteed time, the order of payment, as well as the time period during which the offer for concluding a contract is valid, is available at PLAZARIUM Store. Product description located on the website is a recommendation. Inconsistency of product description on the website may not be grounds for a refund of goods.

1.5. At the time of goods delivery, in written form in the operating instructions, in the technical documentation supplied with the product, on labels, by marking or by other means the Consumer is provided with information on goods, as well as information about the order and terms of exchange / return policy.

1.6. The consumer has the right to refuse the goods at any time after making the payment with a full cash refund, but no later than 10 days prior to the date of shipment or transfer of goods to the post office or shipping company, and after delivery - within seven days, provided the conditions of return set forth in this agreement have been met and the goods have not been put into operation.

1.7. Pilot operation of the goods in the appropriate department of the company (optional service) is possible in cases where the goods have been paid for, the warranty card is filled (contains all the necessary entries), and means the goods were placed into operation. Pilot operation of goods by the consumer at remote method of selling is not available, and its implementation means the commissioning of goods.

2. Order processing
2.1. The buyer notifies the seller about his intention to purchase goods over the Internet by filling out the order form corresponding to the model of the product at PLAZARIUM Store.

2.2. The following information must be included in the order form:

1) Full name of the purchaser or person on his behalf (the recipient);
2) Complete address with zip code at which to deliver the goods, contact phone of the purchaser; 
3) Name of the product, the brand, the number of purchased goods (to be chosen in the form itself from a list of products and parts);
4) The chosen method of delivery and the country of delivery (delivery methods and rules are described in the relevant section of our website). 

2.3. The seller shall ensure the confidentiality of personal data; more details can be found in the Privacy policy section.

2.4. When ordering products through the Internet the buyer confirms his consent with the present rules by clicking "Submit Order". This confirmation means that the buyer agrees to buy the goods from the seller on the conditions specified in these rules as well as all the additional applications posted on the site which are an integral part of the Rules of Site Use. Warning! Lack of buyer’s signature in the warranty card in case of remote method of sale does not cancel the buyer’s agreement with these rules.

2.5. When selling goods using the remote method before signing the contract of purchase and sale the seller offers the buyer a delivery service through sending the goods by post or shipment indicating the method of delivery used and the type of transport (methods and delivery rules are described in the relevant section of our website). 

2.6. Information about the seller, the product and its manufacturer is made available to the buyer in English and in other languages at the discretion of the seller.

2.7. Information on services, their prices and terms of service, as well as the forms of service in the sale of goods is available at PLAZARIUM Store.

2.8. When ordering, the customer will be sent a contract for products ordered in PLAZARIUM Store.

2.9. The contract shall be deemed concluded in the proper form from the moment the buyer transfers money to the settlement account of the seller.

2.10. Settlements with customers are implemented by non-cash payments.

2.11. Seller's obligation to transfer goods and other obligations related to the transfer of the goods shall arise once the seller receives confirmation of 100% payment made by the buyer.

3. Delivery of goods
3.1. Delivery service offered by the seller shall be provided only with the buyer’s consent.

3.2. The seller holds a presale preparation of the product prior to delivering it to the buyer and warrants that he delivers the goods of proper quality, in container and (or) package, in a certain completeness, with documents relating to the goods and accessories.

3.3. Cost of assembly and (or) installation of products (if available) are not included in the price.

3.4. After receiving the goods the buyer checks the appearance and completeness of the goods.

3.5. Buyer confirms that he has no claim to the appearance and completeness of goods by signing the warranty card. After acceptance of goods by the buyer or 7 days after receipt of the goods the seller claims no responsibility for the quality and completeness of the product.

4. The terms and conditions of exchange and return policy
4.1. This product belongs to the category of expensive and technically sophisticated products for household and economic purposes, its warranty period - 24 months from the date of sale. Upon receipt of the technically sophisticated goods of good quality the buyer may not claim to return or exchange them for similar goods of other size, shape, size, style, color or configuration. (A list of non-food products of good quality which are not subject to return or exchange for similar goods of other size, shape, size, style, color or configuration, paragraph 11 – approved by the Russian Federation Government Decree from January 19, 1998 № 55 (amended on 20.10.98, 02.10.99 and 06.02.2002)).
Thus, the goods of PROPER QUALITY from the product range of PLAZARIUM LLC cannot be returned or exchanged.

4.2. PLAZARIUM Ltd. is favorable to its customers and enables the exchange and return of goods of appropriate quality in case of their incompliance of technical performance of the product with the operating conditions of the consumer.

4.3. The buyer has the right to refuse the goods at any time before their receipt. If you have detected the non-conformity of product to your working conditions and decided to terminate the contract of sale, you can do it if the following conditions are met:
1) 7-day period prescribed by the Law on Consumer Protection for the return goods of appropriate quality has not run out.
          a. Compliance with this requirement implies that the consumer has the right to return the products of good quality if he declares to the seller and has documented his claim within 7 days of the receipt of goods.
2) Goods are in salable condition, the consumer properties of goods, seals, labels are preserved.
           b. Compliance with this requirement implies that along with the goods the consumer is obliged to present the entire set of accessories (including packaging), as well as all the technical and operational documentation given to him by the seller.
           c. Compliance with this requirement implies that the goods have not been put into operation, have not been used, the warranty seals are intact, the individual package of the components is not damaged, the burner has not been refueled with the working fluid, it has not been switched on nor tested, etc. That is there were no actions that would directly or indirectly lead to the loss of salable condition, use of the machine resource, load and deformation of structural elements according to both prescribed and not prescribed maintenance documentation. The returned product must be free of external and internal damage.
           d. Availability of service center conclusion.

4.4. Exchange of goods implies an exchange for another model with paying the price difference.

4.5. Products of proper quality cannot be exchanged or returned if the product has individually defined properties (has specific characteristics); if the specified goods can be only used by the consumer who had acquired them. In particular, the products made by the seller on an individual consumer's order are non-refundable.

4.6. Products of proper quality which the seller or a specialized organization have started to install (installation) are non-refundable from the beginning of such an installation.

4.7. In the case of an exchange or refund of goods of appropriate quality acquired remotely the buyer pays for transportation services; cost is determined by the delivery service.

4.8. All contact details can be found in the warranty card.

4.9. To return an item, you must notify the seller, properly pack the unit corresponding to the state of supply, pay for shipping and send the goods to the following address: 8 Tvardovskogo Str., Bldg. 1, 123458, Moscow, Russian Federation, recipient PLAZARIUM LLC, or bring the purchased goods in complete set in the central office of the company at 42 Volgograd Prospekt, Bldg. 5, 109316, Moscow.
It is necessary to attach the following supporting documents:
           a. Commodity waybill for the goods – a copy
           b. An invoice for the commodity waybill for the goods – a copy
           c. The original letter with a refusal of goods which did not fit you according to their operating conditions and the reasons for refusal and details for the money transfer.

4.10. Act of transfer and acceptance of goods for the troubleshooting is drawn up. Then the goods are handed over to the technical expertise in order to confirm compliance with the conditions of goods return. On the completion of the examination manager will tell you the results. An expert opinion is a prerequisite for making a decision on the satisfaction of the Purchaser's claim. The buyer has the right to self-refer to an authorized service center for inspection. In this case, besides the product in complete set the Buyer provides the act of technical expertise.

4.11. When referring to the office the buyer must have an identification document.
4.12. The buyer has the right to refuse the goods at the time of delivery if the delivered goods are of improper quality. To exchange goods of improper quality you must have the conclusion of an Authorized Service Center (phone number and address are listed on the warranty card). Based on this conclusion, at your request we will exchange it for a similar product or will give you a refund. Refund or exchange of goods of inadequate quality is free of charge.

4.13. Goods purchased from our company the fault of which occurred due to the fault of the manufacturer or seller and not related to the violation of the rules of operation are returned in accordance with the established rules of Warranty service to the authorized service representative.

4.14. In case of problems with the product, first, make sure that you are fully familiar with the operating instructions. The manual has a section that describes common problems and ways to solve them on your own.

4.15. In case the result of the examination of goods established that its defects arose due to the buyer’s actions, the law provides for the buyer's obligation to reimburse the costs associated with the examination.
